TERMS and CONDITIONS
Reserving and participating in any travel services INVEST EARTH LLC offers. Dba MAGNO TOURS acting as tour operators or intermediaries in the distribution of products packaged by other tour operators (from now on, “The Company,” “we,” “us”), constitutes a contractual agreement between the participant (“you”) and The Company and the tour operator and is an acknowledgment that you have read, understand, and agree to be bound by these Terms & Conditions (“Terms”), which include a Health & Safety Waiver and any other applicable waivers (see “Waivers” section) for your trip. You must be at least 18 years of age to make a reservation. In all cases, the person making the reservation represents and warrants that all participants have consented to, accepted, and agreed to be bound by these Terms and Conditions.
The Company (and the tour operator if applicable) reserves the right to update or amend these Terms and Conditions before and after any group and individual departure date. Any payment to The Company shall constitute full acceptance of these Terms and Conditions, including a Health & Safety Waiver.
Group Reservation Requirements:
Group reservations consist of 10 or more participants departing from one city from any country and must travel together as a group on the entire journey.
Pricing Guarantee:
Our transparent pricing structure shows the cost per person based on two people sharing a room. All-inclusive group tour prices cover airfares, except when noted on specific itineraries, and are subject to change without notice. Once The Company (and the tour operator, if applicable) processes any payment for services, you will receive a confirmation of your selected tour program, ensuring your peace of mind and a smooth planning process.
Tour Payments:
The accounting department must receive your payments on or before the due dates specified on the tour reservation form. The accounting system manages and controls all reservations automatically, and if payments are not received on or before the due dates, the system will cancel the reservation, and any payments received will be forfeited. Once a reservation is canceled, it is not guaranteed to be reinstated. In cases where the reservation is reinstated, a minimum fee of $175.00 per person will be charged, and a higher fee may apply for reservations with multiple services such as airlines, hotels, cruises, trains, and any service required for the end user.
Forms of Payments accepted by the firm:
The Company accepts payments via Zelle, wire transfer, and credit cards, which are processed by PayPal. Credit card payments through PayPal incur a processing fee of 3.63%, which the traveler must pay.
Confirmation of Reservation:
Your reservation is confirmed when your initial deposit payment is processed. Your invoice, when documented as payment received, confirms the reservation's services.
Accuracy of Invoice Details
Accuracy of Invoice Details: you play a crucial role in ensuring the accuracy of your reservation. It is your responsibility to provide and verify full, complete, and accurate information for all tour participants at the time of reservation. The Company is not liable for any errors or omissions in your information. If you do not notify Us of any error within 5 days of making the reservation, you will be solely responsible for any fees due to incomplete, erroneous, or inaccurate details.
Errors & Omissions
Price Correction Policy: in the rare event that the price listed, quoted, or confirmed is incorrect due to a system error, human error, or other error, The Company or the tour operator reserves the right to correct the price. We will promptly inform you of the error and the correct price. You will then have the option to accept the corrected price or cancel your reservation without penalty.
Travel Cancelation and Medical Assistance Insurance:
Travel insurance may reimburse you for your pre-paid, non-refundable trip costs — including vacation rentals, car rentals, hotels, flights, group tours, and cruises — if you must cancel for a covered reason. In addition, it may reimburse you for care following a covered medical emergency while traveling. If needed, the travel insurance company may even arrange and pay for a medical evacuation. The Company offers this valuable coverage to all tour participants on an individual basis at affordable prices, making it a practical addition to your travel plans. We highly recommend never traveling to any destination in the world without it.
Trip Documents Required:
It is your proactive responsibility to obtain and have in your possession proper and valid documentation required for entry and departure for each country you travel. You are solely responsible for the cost incurred during travel for missing, incomplete, or defective documentation. The Company (and/or the tour operator if applicable) is not liable for any loss or expense incurred due to loss, damage, or errant entry, exit, due to incomplete travel documentation.
Passports:
A valid passport is required to travel internationally. Passports must be valid for at least six (6) months beyond the conclusion of your trip. The Company (or the tour operator if applicable) requires your passport details before final documentation for all international travel.
Vaccinations or Medical Certificates:
You are responsible for verifying medical requirements for your travel. This includes but is not limited to, vaccinations, medical certificates, and required travel insurance policy.
Visas:
It is your responsibility to obtain and verify the validity of visas and determine if visas are necessary for your trip. Securing and paying for all visas, entry documents, and any other requirements for entry into a country is your responsibility. It is crucial that you always carry these documents with you. The Company (and/or the tour operator if applicable) is not liable for denial of entry or exit or costs incurred for not having correct and complete documentation.
Waivers General:
During your group tour, cruise, or excursion, you may encounter the opportunity to participate in additional, optional activities that independent third-party suppliers provide. The suppliers of those optional services may render those services subject to separate and additional terms and conditions or require you to execute additional documents, waivers, or releases. It is understood that any assumptions of liability, waivers, or releases that are part of the suppliers’ terms and conditions or required by those independent suppliers will also endure to the benefit of The Company (and/or the tour operator if applicable).
Participant Cancellations & Refunds:
You may cancel your reservation by notifying The Company in writing via email to groups@magnotoursinc.com. The calculation of cancellation penalty amounts includes all services and fees on the invoice. All cancellations will have penalty fees, which may be a minimum of the tour deposit and as high as 100% of the tour package cost paid by the tour participant. The firm has to notify the airlines, ground and cruise operators of contractual changes related to the cancellation request by the tour participant. The contract change takes on average 30 to 60 days to process. Authorized refunds will be issued on average 45 to 60 days from the cancellation notification received date.
Group Tour Departure Postponement or Cancellation by The Company:
The Company or the tour operator reserves the right to postpone or cancel any trip departure if there is insufficient demand due to strikes, lockouts, riots, stoppage of labor, or a Force Majeure Event (see under Force Majeure). This is to ensure the safety and comfort of all participants.
In the event of a postponement by The Company (or the tour operator if applicable) before departure for reasons due to Force Majeure (see section “Force Majeure”), The Company, on behalf of the tour operator if applicable, will try to rebook the same trip with a different departure date, or a similar journey, but there is no guarantee of availability. If appropriate, the Company, on behalf of the tour operator, will refund the difference in price if the alternate is lower. You are responsible for additional costs if the alternate is higher.
If The Company (or the tour operator if applicable) cancels the trip before departure or during your trip due to conditions under Force Majeure (see section Force Majeure), You will receive a future travel/booking credit for the affected portion of your trip. This credit, which is redeemable for a maximum of three (3) years past your original trip start date, can only be used for any of the group tours offered by The Company.
Force Majeure:
In the event of a Force Majeure Event (as defined below), The Company (and the tour operator if applicable) shall be excused, discharged, and released from performance to the extent such performance is limited or prevented, without liability of any kind. The Company (and the tour operator if applicable) assumes no liability for any loss, damage, or entry of any nature in whole or in part resulting from an Act of God or any other condition outside The Company’s responsibility, the tour operator’s control (Force Majeure Event), including without limitation:
Fire, Landslides, Volcanic eruption, Inclement weather, Environmental pollution or contamination, Earthquake, Low or high-water levels, Flood, Water or power shortages or failures, Tropical storms or hurricanes, Riots or civil commissions or disturbances, or any other acts of similar nature, Sabotage, Strikes of labor disruptions, Arrests, Restraint of rulers or peoples, Expropriations, Acts of terrorism, War, Insurrection, Quarantine restrictions, Government health advisories or warnings or alerts of any nature, including, but not limited to, warnings or regulations due to an epidemic/pandemic, Government seizures, Refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, Damages to its facilities or the travel supplier and its facilities, or any unforeseen circumstances or factors unexpected by The Company, or the tour operator if applicable, that adversely affects or hampers its ability to fulfill any of its contractual conditions. If The Company or the tour operator, if appropriate, reschedules a trip departure due to a Force Majeure Event, the cancellation and refund terms in this agreement shall apply.
The Company:
INVEST EARTH LLC. Dba MAGNO TOURS, at 1712 Pioneer Ave., Suite 500, Cheyenne, Wyoming 82001, is an independent company (“The Company”) that organizes group and independent travel products made on their own or packaged by the tour operators. Trip services, including, but not limited to, transportation, sightseeing, and accommodations, are provided by third-party suppliers.
Company Representative:
No person other than an authorized representative of The Company by a document in writing is authorized to vary, add, or waive any Term or Condition on its brochure or website, including any term or condition outlined in the preceding provisions. The provision of these Terms may not be waived or varied except in writing and signed by the party or parties to be bound.
Liability:
The trip participant agrees that, to the maximum extent allowed by applicable law, neither The Company nor its affiliates shall be liable for any damage, loss (including personal injury, death, and property loss), or expense occasioned by any act or omission of any supplier (including any Service Provider) providing services, any insurer or insurance administrator, or any other person.
Service Providers:
Air carriers, accommodations, and other suppliers (including but not limited to suppliers of trains, cruises, ferries, motor coaches, hotels, excursions, and restaurants) providing services (Service Providers) are independent third-party contractors. They are not agents, employees, servants, or joint ventures of The Company or its affiliates. From time to time, and to identify those Service Providers as the provider of a component or part of a group tour, cruise, independent package, or any other travel service, some or all those entities may utilize the name The Company in promotional media, signage, or attire. Although you may see The Company name on vehicles, signs, apparel, or elsewhere during your group or independent tour, its use by Service Providers is solely for identification. It does not represent or signify ownership, management, supervision, direction, or control, or the right to direct or control by The Company of services provided by the Service Providers or of the employees, servants, or agents of the Service Providers. All certificates and other Trip Documents for services issued by The Company are subject to the Terms and Conditions specified by any of our Service Providers.
Service Responsibilities:
After departure, if the Services included in the trip cannot be supplied or there are changes in an itinerary for reasons beyond the control of The Company (or the tour operator if applicable), depending on the circumstances, The Company (or the tour operator if applicable) will take reasonable action to arrange for the provision of comparable services.
Disputes:
Any dispute between the trip participant and The Company, directly or indirectly relating to the Terms and/or to the trip undertaken, shall be first submitted to mediation in Cheyenne, Wyoming before a mediator mutually agreed to by the parties. In the case of travel packages distributed by The Company as the intermediary for the tour operator, disputes regarding the travel itself will be referred to the tour operator.
Any action arising out of or related to these Terms and Conditions, or the travel reserved or undertaken hereunder, shall be brought only in the courts of the State of Wyoming. All trip participants agree that Wyoming shall be the sole and exclusive venue for any such action and hereby consent to the jurisdiction of the Wyoming courts for such action. Any claim against The Company must be brought within 30 days after the date of the completion of the trip and not later. The parties hereby agree and specify that claims may be brought only in the state or federal courts of Wyoming, and the parties specifically consent to jurisdiction and venue in Wyoming. Neither the parties nor any affiliate of the Company shall in any case be liable for damages other than compensatory damages, and the parties hereby waive any right to claim punitive or exemplary damages. The parties further agree that claims may be brought by parties only in their individual capacities and not as plaintiffs or class members in any class action, proposed or purported class action, or other representative action, regardless of the type of proceeding. The parties expressly agree to waive and forego all rights to bring any such class actions, purported or proposed class actions, or representative actions. Wyoming law governs this contract and all proceedings arising out of or related to this agreement.
